The terms in plain words.

Earshot is operated by High5 Labs LLC, a North Carolina company ("we"). These terms cover the Earshot website, the account service at earshot.fm, and the Earshot app for iPhone. Using any of them means you agree to what follows.
The service
Earshot plays podcasts. It fetches the public feeds you ask for, plays their episodes, makes transcripts, and keeps your listening state in step across your devices. The shows, their artwork, notes and audio belong to their publishers and are presented as their feeds provide them. Earshot hosts none of the audio.
Your account
An account is for one person. You are responsible for keeping its password to yourself and for what happens under it. We may close an account that abuses the service, for example by using the feed fetcher as a general-purpose crawler or by attacking other people's accounts.
Earshot Plus
Earshot Plus is a subscription sold by Apple through the App Store under Apple's terms, which govern the purchase. It renews until you cancel, and you cancel in your Apple account's Subscriptions settings; cancelling keeps Plus running until the end of the period you paid for. Refunds are Apple's to grant, through Apple's own process. We publish the current price in the app and on earshot.fm, and a price change applies only to renewals after Apple has told you about it.
Transcripts
Transcripts are machine-made and can be wrong. They are a convenience for listening and searching, not a record of what was said.
Availability and liability
The service is provided as is. We work hard on durability, especially of your playback positions, but we cannot promise uninterrupted service or an error-free one, and to the extent the law allows, we are not liable for losses that come from using or being unable to use Earshot. Where the law gives you rights that cannot be waived, those rights stand.
Changes
If these terms change in a way that matters, the date at the top changes with it, and continuing to use Earshot after that date means you accept the new terms.
